“During the meeting on the development of the PDA “Beringovsky” and the free port of Vladivostok in the part of the city district of Pevek, a report was made by Mr. Tikhonov Denis Vladimirovich, participant of the retreat of the head of the JSC “Corporation for the Development of the Far East “. The basis of the report was information on the results of the work of representatives of the JSC “Corporation of Development of the Far East” in the region and its plans for the near future. Within six months of the representatives of the corporation in the territory, 10 applications for activities in the PDA “Beringovsky” were officially accepted. 10 applications were brought to the status of approval and conclusion of residence agreements, which is certainly a positive factor in assessing the work of the mission in the territory. “The expectations of the Chukotka Development Fund from the meeting of the Consultative Council are in the sphere of searching for solutions to the applicability of customs privileges for investors realizing their projects in the difficult conditions of the Arctic and the Far North. In preparation for the meeting, the Foundation carried out preliminary work individually with each investor in the territory of advanced development “Beringovsky” in order to identify the bottlenecks in the legislation formed during the implementation of the mechanisms of the free customs zone within the Chukotka Autonomous Region”, Olga Plotnikova commented.

The meeting of the Advisory Council held with the participation of management of the Far Eastern Customs Administration, including the first deputy and deputy head of Customs of economic activities, the largest participants of foreign trade in the Far East, residents of the territories of priority development and the territory of the free port of Vladivostok, with the participation of potential investors, as well as representatives of regional mass media (television, radio, news agencies, online publications and print publications).

On the first issue of the agenda on the implementation of federal laws of July 13, 2015 №212-ФЗ “On the free port of Vladivostok” of December 29, 2014 № 473-FZ “On the territories of advanced social and economic development in the Russian Federation”, incl. On the issues of application of the customs procedure of the free customs zone (STZ), the presenters heard a report by Svetlana Aleksandrovna Utyasheva, deputy director of the Department for Priority Development Area (PDA) and Infrastructure of the Ministry of the Russian Federation.

The second and most significant speaker for residents and potential investors of the Bering Sea and free port of Vladivostok in the part of the Pevek city district was Lyudmila Pulina, Deputy Director of the Development Department for Advanced Development Territories and the Free Port of Vladivostok, JSC Far East Development Corporation. The main theme of her report identified problem issues for investors implementing their projects in the Arctic and the Far North. Severe natural and climatic conditions, characterized by extremely low temperatures, unstable weather conditions, strong winds, geographically distant and local location of settlements or industrial facilities – all these factors do not allow to fulfill the necessary volume of requirements of the customs legislation on the arrangement of customs control zones. And non-compliance with the norms of the law, in turn, prevents residents from receiving customs preferences. A number of requirements within the Arctic and the Far North are not simply not technically feasible, but excessive and ineffective in territories located outside of civilization, for example, fencing customs control zones for coal-producing or gold companies. For such territories, it is necessary to work out individual requirements for the equipment and arrangement of free customs zones and customs control zones, adapted to the real operating conditions. A plan of work aimed at developing proposals for amendments to the legislation in the form of a separate item for foreign economic entities located in the Arctic and the Far North is outlined. Ms. Pulina emphasized the need for detailed study of the justification of the initiated changes with the aim of achieving success in the difficult task set. At the same time, simplification of the requirements for arrangement should not reduce the level of customs control in the FCZ. Residents of PDA Beringovsky supported a promising undertaking. In the course of the dialogue with the colleagues of the customs administration, Ms. Pulina also announced the need to remove the excessive regis- tration currently applied to traders in the form of compulsory application of the customs transit procedure for goods from the point of other storage in the territory, for example, the seaport to the place of operation by residents in the territory of the STZ. This mechanism is obligatory for today even if the participants of foreign trade activities send customs declarations to customs authorities.

Reports were also made by the staff of the Far Eastern Customs Administration. Including First Deputy Head of the Far Eastern Customs Administration Sergey Viktorovich Fedorov spoke about the positive experience in the territory of the Far East of implementing mechanisms of the free customs zone. So, one customs checkpoint, six customs and border control points of the sea type, fourteen checkpoints on the territory of the free port of Vladivostok for cars, trucks and individuals were organized. Gleb Aleksandrovich Kicha, Head of the Customs Control Service of the Far Eastern Customs Administration, informed the participants about the details of the requirements for the organization of customs control points and the need to equip them not only with checkpoints but also with equipment designed for weighing vehicles, as well as, among other things, car signs on vehicles in all weather conditions. Sergei Valerievich Pankratov in his report spoke about the planned changes in the customs legislation in the near future, incl. On the draft legislative acts, which are at the stage of discussion and consideration. For example, a change is planned regarding the application of the norms of customs legislation in the coastal waters. We also discussed some features of the withdrawal of the STZ status. For example, the withdrawal of the STZ status in respect of real estate can only be applied at the same time as the termination of the status of the PDA resident.

The second item on the agenda of the meeting of the Consultative Council on Work with Participants in Foreign Economic Affairs of the DVTU touched upon the implementation of new information customs technologies in the Far Eastern Federal District. The report of Oksana Nikolayevna Dolgikh, the head of the department for the introduction of advanced customs technologies for the customs control service of the Far Eastern Customs Administration, introduced the participants to the meeting with innovations. So, now there is an opportunity of remote examination of the imported goods with application of new software complexes. Electronic digital signature functions are available today to all participants of foreign trade activities and are low-cost both financially and in time. In the near future, automated accounting will be introduced for all participants in foreign economic activity of the territories of priority development and the free port of Vladivostok. In the long term, such accounting will replace existing requirements for the development of customs control zones and significantly minimize the costs of investors directed to meet the requirements of regulatory authorities. These changes are planned to apply to the territories of port and logistics sites. For today, they pass the coordination of the Ministry of Justice and the Ministry of Finance.

In the final part of the meeting, special attention was paid to the issues of the residents of the PDA and the free port of Vladivostok to the representatives of the customs regulatory bodies that monitor the implementation of legislation and the application of the benefits of customs legislation. Residents proposed to refine the mechanism of individual allowances for the arrangement of the STZ in terms of a one-time opportunity for its use. At the time of application of repeated imports for goods or equipment organized by the FCZ or vehicles, individual measures of preferential treatment for today are canceled, which is not relevant.

Summing up the results of the meeting, the colleagues of the customs administration discussed the possibility of navigation on regulatory documents of the Customs legislation, preferential procedures for the application of certain norms, the availability of visualized material in free Internet access, incl. During the six months of the actual work of the Foundation, 14 sets of documents for the formation of applications for the implementation of activities in the advanced development area “Beringovsky” were accepted. The amount of planned investments by bids amounted to about 12 billion rubles. Applicants for PDA residents claim creation of 1,026 workplaces during the implementation of the projects. Projects are multidirectional in content and industry.

Already registered at the current date in the PDA “Beringovsky”, with the participation of the Chukotka Development Fund in the preparation of sets of applications, 7 residents for the amount of investments 611.5 million rubles. Within the framework of the projects phased creation of 95 workplaces was declared.

At the date of the II Eastern Economic Forum, with the support of the Chukotka Development Fund, 10 residents are expected to register. The amount of investments for projects planned for implementation will amount to 11.6 billion rubles. Investors will create 941 workstations within the framework of projects.

During the six months of the actual work of the Foundation, mechanisms for reducing the time frame for collecting information and searching for optimal solutions for potential investors have been worked out. Assistance is provided on a free basis for drafting business plans and consulting on the completion of applications to business representatives, investors and potential economic entities of the Chukotka Autonomous Region. An individual project implementation plan is built for each application, each project, each investor.

It is possible to recognize reduced administrative barriers. Each resident and applicant to the residents is accompanied individually.

Of course there is much more to strive for. There are questions that require a separate detailed study, incl. with customs authorities.

In general, the mechanism of TOP has shown its effectiveness in the Far East, as evidenced by the figures for the first half of 2016:

  • Received 159 official applications from investors for the implementation of investment projects in the PDA for a total investment of 507.529 billion rubles.
  • 28.5 thousand new jobs will be created.
  • There are 4 enterprises, 23 enterprises – at the stage of construction and installation work.
  • But the fact that the creation of the 13th PDA in the Far East – “Amuro-Khinganskaya” in the Jewish Autonomous Region was approved.

Among the residents of the PDA “Beringovsky” there is both a large and a small business. Therefore, the projects that will be implemented in Chukotka are different in scale and content. Among them: reconstruction of wind power stations, gold mining, construction of landfills, coal mining and export, modernization of water and power plants, fishing, warehousing and auxiliary transport, crop production, etc.

Within the framework of work with the residents of the PDA “Beringovsky” – full support is provided for the formation of applications by residents and maintenance of projects throughout their lives. All services are free of charge.

It is planned to sign an agreement with KRED on the interaction and cooperation in the field of attraction and support of residents of PDA and SPV. The signing of this agreement will provide a positive vector for the development of the region as a whole and will strengthen opportunities for potential investors through consolidated coordination on the path to the implementation of ambitious plans.

At the event dedicated to the implementation of the mechanisms for the application of special business regimes for residents of the territory of the advanced social and economic development of Beringovsky (PDA) and the free port of Vladivostok (SPV), issues were discussed about the problems and prospects of entrepreneurship development within these zones, the availability of existing mechanisms Customs privileges, as well as the work of public authorities to improve the investment climate in the Chukotka Autonomous Region.

Opening the Round Table, Deputy Governor Alesia Andreevna Kalinova noted that in the current situation, public authorities, within their authority, are called upon to help the business community in solving problems related to customs regulation, tax legislation, to help reduce administrative barriers, and to create Favorable conditions for expanding the circle of entrepreneurs of Chukotka.

– I would like to see that the main motive for carrying out control measures implemented by state bodies was not to “find and punish” but to “identify, help and prompt” – this is the mechanism that presupposes the very purpose of creating PDA or SST, and this is the help for Entrepreneurs from the state authorities, which they expect, – said Alesia Andreevna Kalinova.

Andrei Shamilevich Mingazov, First Deputy Head of the Department of Industrial and Agricultural Policy of the Chukotka Autonomous Region, commented on the work on improving the mechanisms for the application of special economic regimes within the zones formed in the territory of the Chukotka Autonomous Region.

– There are a number of large projects in the territory of the Chukotka Autonomous Region, large in scale and lengthy in the implementation stages, which do not require support from public authorities in the form of, for example, tax preferences. This should be taken into account when creating new territories for special economic zones, taking into account the needs of budgetary support for the development of the economy of the region as a whole. At the same time, it is necessary to understand the specifics of the region and feel the need to support the development of related industries around large investors. Here it is just necessary to “identify, help and prompt.” There is a field for joint work of representatives of the authorities and supervisory bodies over the mechanisms of applying preferences both within a single settlement, district, and for the economy of the district as a whole. Among the industries that require special attention are transportation services, including not only the transportation of oversized cargo, but also passenger, warehouse and so on, as well as the development of energy.

Elena Anatolyevna Kompanets raised the issue of the conditions for applying the free customs zone regime in respect of residents of the PDA and SPV and the obligation to pay customs and tax payments in the event of the sale of goods and services by a resident to a non-resident. In this case, the differences between the resident having certain preferences and the non-resident who do not have rights to any preferences are leveled.

– It is necessary to further work out the mechanism for using the customs regime of the free customs zone with reference to such unique territories as TOR “Beringovsky” and Free Port of Vladivostok, which included the city district of Pevek. We understand that, first of all, residents who carry out processing activities will benefit. It is necessary to work out more detailed conditions for the application of the free customs zone for other industries, including in the sphere of transport and other services. Only in this case it will be possible to achieve a tangible economic effect and development of our own production and services in the Arctic part of the Far East, “commented Elena Anatolyevna Kompaniets.

Andrei Valerievich Zinchenko, the head of the Anadyr customs post of the Magadan Customs of the Far Eastern Customs Department, shared experience of implementing preferential treatment mechanisms in the Special Economic Zone in the Magadan Region, listed the minimum of controlled parameters for the planned areas of customs control within the PDA Beringovsky and SPV in the city district Pevek. He drew attention to the permissible types of activity in relation to which it is possible to apply certain preferences within the framework of the customs legislation.

– The customs authorities are ready for cooperation and joint work on the implementation of the projects of the territory of the advanced social and economic development of Beringovsky and the free port of Vladivostok. I consider it necessary to determine the format for holding joint working meetings with residents of the PDA and free port Vladivostok in the city district of Pevek, planning to engage in foreign economic activities, in order to work out timely issues. Residents of the PDA and the Pevek city district as part of the SPV on all emerging issues may also apply directly to the Anadyr customs post of Magadan Customs or Magadan Customs.

In his report on the results of the work of the non-profit organization Fund for the Development of Economics and Direct Investments of the Chukotka Autonomous Region, the head of Plotnikova Olga Sergeyevna told about the results of work in attracting and accompanying the Bering residents to the PDA.

However, for today it is revealed the need to pay special attention to special preferential treatment provided to residents of PDA and free port Vladivostok within the framework of the Customs Code of the Russian Federation. PDA “Beringovsky” is located in the territories of municipal entities Anadyr Municipal District and Anadyr City District of the Chukotka Autonomous Region. The main task of the PDA is the integrated development of the Anadyr industrial zone, one of the advanced development zones defined by the Chukotka Autonomous Region Development Strategy, based on the development of the Bering coal deposit with more than 1 billion tons of coal resources.

The resident project assumes the modernization of the diesel power plant in the village of Beringovsky during 2017-2019. It is planned to dismantle obsolete equipment, repair the premises of the power plant as a whole and install a new diesel-generator equipment.

The amount of investments will be 27 170 thousand rubles. The term of the agreement on the implementation of activities in the territory of advanced development “Beringovsky will be ten years. The number of new jobs created will be no more than 19 pieces. The project “Attraction of private investors in public utility systems” was created within the framework of the Action Plan on attracting private investments into the housing and communal services of the Chukotka Autonomous Region, approved by the Governor of the Chukotka Autonomous Region from June 20, 2016 No. 161-rg “On measures to attract Housing and Communal Services of the Chukotka Autonomous Region of Private Investments”.

  • summarizing the preliminary negotiations with potential and current investors in the housing and communal services sector,
  • requesting and collecting information and materials on the existing schemes for heat, water and electricity in municipal administrations districts, city districts, organizations of housing and communal services, data on facilities and complexes of the infrastructure for generation and transportation of heat, electricity and the system of water supply of settlements of Chukotka,
  • etc.

The Department of Industrial and Agricultural Policy of the Chukotka Autonomous Region, the results achieved within the framework of the project “Concessions – Challenges for Entrepreneurs of Chukotka” are assessed as acceptable.

The main theme of the speech of each of the parties involved is the stages and mechanisms for optimal phased interaction in the implementation of the large-scale Chukotka Autonomous Region Project “Attraction of private investors in communal infrastructure systems” and the construction of a plan for its further successful implementation.
